The paper deals with the question of whether poverty as such violates the dignity of persons. It is argued that it does. This is, it is argued, not due to a lack of basic goods, nor to the fact that poverty prevents persons from enjoying the rights they have, particularly the right to bodily integrity. Poverty does violate dignity, so it is argued, insofar as poor people are dependent on others in a degrading way.

Despite the reported limited success of conventional treatments and growing evidence of the effectiveness of adult bariatric surgery, weight loss operations for (morbidly) obese children and adolescents are still considered to be controversial by health care professionals and lay people alike. This paper describes an explorative, qualitative study involving obesity specialists, morbidly obese adolescents, and parents and identifies attitudes and normative beliefs regarding pediatric bariatric surgery. Views on the etiology of obesity—whether it should be considered primarily a medical condition or (...) more a psychosocial problem—seem to affect the specialists’ normative opinions concerning the acceptability of bariatric procedures as a treatment option, the parents’ feelings regarding both being able to influence their child’s health and their child being able to control their own condition, and the adolescents’ sense of competence and motivation for treatment. Moreover, parents and adolescents who saw obesity as something that they could influence themselves were more in favor of non-surgical treatment and vice versa. Conflicting attitudes and normative views—e.g., with regard to concepts of disease, personal influence on health, motivation, and the possibility of a careful informed consent procedure—play an important role in the acceptability of bariatric surgery for childhood obesity. The thesis that the probability of a conditional`if A, C' is the corresponding conditional probability of C, given A, enjoys wide currency among philosophers and growing empirical support in psychology. In this paper I ask how a probabilisitic account of conditionals along these lines could be extended to unconditional sentences, i.e., conditionals with interrogative antecedents. Such sentences are typically interpreted as equivalent to conjunctions of conditionals. This raises a number of challenges for a probabilistic account, chief among them the question (...) of what the probability of a conjunction of conditionals should be. I offer an analysis which addresses these issues by extending the interpretation of conditionals in Bernoulli models to the case of unconditionals. (shrink)

Background When anti-cancer treatments have been given market authorization, but are not (yet) reimbursed within a healthcare system, physicians are confronted with ethical dilemmas. Arranging access through other channels, e.g., hospital budgets or out-of-pocket payments by patients, may benefit patients, but leads to unequal access. Until now, little is known about the perspectives of physicians on access to non-reimbursed treatments. This interview study maps the experiences and moral views of Dutch oncologists and hematologists.Methods A diverse sample of oncologists and hematologists (...) (n = 22) were interviewed. Interviews were analyzed thematically using Nvivo 12 qualitative data software.Results This study reveals stark differences between physicians’ experiences and moral views on access to anti-cancer treatments that are not (yet) reimbursed: some physicians try to arrange other ways of access and some physicians do not. Some physicians inform patients about anti-cancer treatments that are not yet reimbursed, while others wait for reimbursement. Some physicians have principled moral objections to out-of-pocket payment, while others do not.Conclusion Oncologists and hematologists in the Netherlands differ greatly in their perspectives on access to expensive anti-cancer treatments that are not (yet) reimbursed. As a result, they may act differently when confronted with dilemmas in the consultation room. Physicians working in different healthcare systems may face similar dilemmas. (shrink)

John Duns Scotus deals with a question which is still of importance for modern ethical debate, namely what is the difference between a good deed which is intended but may be hindered by the circumstances and a good deed which is both intended and consummated? Scotus discusses this issue in connection with the question of whether moral goodness or badness can be assigned to the external act, which depends on physical capability. In his investigation, he determines that the imputability of (...) acts, i.e. the fact that the actor had free power of disposition over them, is a criterion for being able to morally qualify them as good or bad. His conclusion that one can clearly attribute the external act with its own moral good or evil is primarily based on his definition of the moral good as the totality of circumstances necessary according to right reason for a good act. William of Ockham expressly rejects Doctor Subtilis' conclusion and relativizes his criterion of moral goodness to the point of meaninglessness. Ockham attributes the moral good or evil of an act almost exclusively to the actor's intention. He explains the moral significance attributable to the actual consummation of an intentional action in terms of the acts of will occurring during and after consummation, which can be morally judged in their own right. He does admit, however, that a judgment made by mortals is based on criteria different from those relevant in the eyes of God. Today, the particularly interesting aspect of this debate seems to be that a moral conception similar to Kant's is confronted with a position that can still be called Aristotelian, albeit with some Augustinian influence. Yet the perceivable theoretical proximity between these two authors could indicate a possible connection between two of the most important ethical concepts in the history of occidental philosophy. Die auch für moderne Ethikkonzepte nicht unwichtige Frage, worin der moralische Unterschied zwischen einer nur gewollten, aber durch die Umstände verhinderten und einer ausgeführten guten Tat liegt, wird von Johannes Duns Scotus im Zusammenhang mit der Frage bearbeitet, ob dem äußeren, auf körperliche Vermögen angewiesenen Akt eine eigene moralische Güte oder Schlechtigkeit zukommt. Bei seiner Untersuchung ermittelt er als Kriterium für die moralische Qualifizierbarkeit in die eine oder andere Richtung die Zurechenbarkeit von Handlungen, d.h. den Umstand, daß sie in der freien Verfügungsgewalt des Handelnden stehen. Das Resultat seiner Überlegungen, daß nämlich der äußeren Handlung sehr wohl eine eigene moralische Güte oder Schlechtigkeit zugesprochen werden kann, basiert wesentlich auf seiner Definition der moralischen Güte als Gesamtheit der gemäß der rechten Vernunft für eine gute Handlung erforderlichen Umstände. Wilhelm von Ockham weist das Resultat des Doctor Subtilis ausdrücklich zurück und relativiert dessen Kriterium moralischer Güte bis zur weitgehenden Bedeutungslosigkeit. Er führt die moralische Güte oder Schlechtigkeit eines Aktes ausschließlich auf die Intentionen des Handelnden zurück und erklärt die eigene moralische Bedeutung, die der Ausführung einer willentlichen Handlung zukommt, durch die während und nach der Ausführung stattfindenden Willensakte, die ihrerseits moralischer Beurteilung unterliegen. Allerdings gesteht er zu, daß die Beurteilung durch die irdische Gerichtsbarkeit z.T. anderen Gesichtspunkten folgt als die vor den Augen Gottes. Heute scheint an dieser Debatte vor allem der Umstand interessant, daß eine der kantischen nicht unähnliche Moralkonzeption mit einer trotz aller augustinischen Einfüsse noch aristotelischen Position konfrontiert wird. Die dennoch feststellbare theoretische Nähe beider Autoren könnte Hinweise für eine mögliche Verknüpfung dieser beiden wohl wichtisten Ethikkonzepte der abendländischen Philosophiegeschichte geben. This essay, part of a special issue on the Warburg Institute and Library, offers personal recollections of scholars whom the author encountered there as a student in the early 1970s, including E. H. Gombrich, Otto Kurz, Michael Baxandall, Frances Yates, D. P. Walker, A. I. Sabra, Michael Podro, Michael Screech, Arnaldo Momigliano, and Nikolaus Pevsner. The author's focus is on differences between the milieu of the Kulturwissenschaftliche Bibliothek Warburg, as it had been in Hamburg, and the ethos of the Warburg (...) Institute in London. The key document for establishing this contrast is an anonymous review — by Edgar Wind — attacking Gombrich's biography of Aby Warburg, which was published in 1970. Wind found the new Warburg circle “Lilliputian” in comparison with the old Hamburg circle, to which he had belonged. This essay disputes Wind's finding, based on its author's own experience, as well as on his sympathy with the reasoned empirical approach of Gombrich, Baxandall, and others at the London Warburg to issues that Aby Warburg had raised when the Library was in Germany. Deep brain stimulation is an experimental procedure for treatment-resistant depression. Some results show promise, but blinded trials had limited success. Ethical questions center on vulnerability: especially on whether depressed patients can weigh the risks and benefits effectively, whether depression causes “desperation,” and whether media portrayals create unrealistic hopes. We interviewed 24 psychiatric inpatients with treatment-resistant depression, qualitatively analyzing their comments. Most had minimal interest in deep brain stimulators. Some might consider them if their depression worsened, if alternatives were exhausted, or (...) if the evidence were stronger. Fears focused on the surgery, adverse effects, and the novelty of the device. Patients felt the depression interfered with their ability to weigh the risks and benefits. Patients seemed highly attuned to the risks, and were skeptical that the treatment would be effective. We conclude that ethical concerns about vulnerability remain, yet patients with treatment-resistant depression were thoughtful and cautious about trying a novel therapy. (shrink)

In a large proportion of health care research based on the retrospective review of records, minimal breach of patient confidentiality appears to be inevitable. This occurs at initial identification of and access to the chart, selected on the basis of the condition under investigation, and while individual identifiability can be blocked at subsequent stages, at this point it does occur. Prospective individual consent is impractical because often neither the desirability nor the specific subject of the research is known at the (...) time of making the record, and retrospective patient tracing to obtain it is often impossible. I argue that the benefit of the research outweighs the minimal breach of confidentiality, and that in my own jurisdiction, this appears to be envisaged and accepted in Canadian law. (shrink)

The rights of the various individuals involved in decision-making in cadaver organ donation are considered, and there is discussion of the relation of human cadavers to the planetary biomass. I conclude that the rights of the potential recipient should outweigh those of the other parties concerned and that education and legislation should recognise and promote this.

The SOPhiA conferences are intended to give young predoctoral philosophers the possibility to actively attend a professional conference, to tackle current, as well as classical, philosophical problems, and to discuss their own approaches with promising students from many dierent countries as well as with wellestablished experts. We are firmly convinced that this is a natural and necessary step for promoting the next generation of analytic philosophers and thus, strengthening analytic philosophy in general. Because we believe that the methods of analytic (...) philosophy can be fruitfully applied to all areas of philosophy, the SOPhiA conferences do not have a thematic focus; this is also reflected by the fact that the talks given at SOPhiA 2011 covered all areas of philosophy. The ethical issues around decision making on behalf of infants have been illuminated by two empirical research studies carried out in Scotland. In-depth interviews with 176 medical and nursing staff and with 108 parents of babies for whom there was discussion of treatment withholding/withdrawal, generated a wealth of data on both the decision making process and the management of cases. Both staff and parents believe that parents should be involved in treatment limitation decisions on behalf of their babies. However, whilst (...) many doctors and nurses consider the ultimate responsibility too great for families to carry, the majority of parents wish to be the final arbiters. We offer explanations for the differences in perception found in the two groups. The results of these empirical studies provide both aids to ethical reflection and guidance for clinicians dealing with these vulnerable families. They demonstrate the value of empirical data in the philosophical debate. (shrink)

The dissertation addresses the relationship between common sense, skepticism, and naturalistic science in Hume. It is argued that Hume's moral science uncovers numerous common illusions of visual and moral perception; it is not a defense of common-sense experience. ;Firstly, Hume views the ordinary experience of causation and external reality as illusory. The former experience is a projection of human expectation; the latter a conflation of perceptions. ;Secondly, it is argued that, according to Hume, the moral judge overlooks his biases by (...) fictively projecting himself to an impartial standpoint. Impartial sentiments are weak, however, and their weakness generates another fiction: they are mistaken for the inferences of reason. Finally, the judge falsely imagines that he can "see" the character of the persons whom he judges, when all that he actually sees are their actions. ;Thirdly, the dissertation contends that, although the practice of justice arises out of self-interest, the moral agent mistakes his personal interest for public benevolence. When his hidden selfishness fails to move him, he acts justly in the hope of re-acquiring the "lost" benevolence that he never actually had. He saves himself from disappointment by misinterpreting his actions as signs of genuine reform. In the case of promising, the agent falsely imagines that he wills its moral obligation into being with the words "I promise." ;Fourthly, it is shown how Hume denies that we can find the historical root of political obedience in enlightened self-interest and instead stresses the founding role of usurpation and conquest, erased from memory by the passage of time and the efficacy of present government. ;Finally, we see that the appearance of virtue and vice is the illusory correlate of our sentiments: we project sentiments of approval and disapproval onto others and then mistake them for objective traits. ;Contrary to what some interpreters have asserted, I conclude that, according to Hume, the philosopher is never cured of his profound skepticism. Skepticism recurs as long as the philosopher philosophizes. This is problematic, however, because at its most radical, skepticism is incompatible with moral science. (shrink)

In the language of secular bioethics, autonomy is always accorded first place in the hierarchy of values that has come to be referred to as the “Georgetown mantra” A dictionary definition of mantra is “a verbal spell, ritualistic incantation, or mystic formula used devotionally,” and the value placed upon autonomy is largely of this nature: uncritical and uncriticised. That there should be and are limits to autonomy is obvious, but these boundaries are undefined, little discussed, and mostly unexplored. To use (...) another metaphor, our emphasis on autonomy is an index of how far the pendulum has swung in an understandable and partly justifiable reaction from, earlier paternalism; has this swing approached its proper limit, and should we be seeking a less extreme and more balanced assessment of autonomy as a bioethical value? It is difficult to reconcile claims about the Father's role as the progenitor of Trinitarian Persons with commitment to the equality of the persons, a problem that is especially acute for Social Trinitarians. I propose a metatheological account of the doctrine of the Trinity that facilitates the reconciliation of these two claims. On the proposed account, ‘Father’ is systematically ambiguous. Within economic contexts, those which characterize God's relation to the world, ‘Father’ refers to the First Person of the Trinity; within (...) theological contexts, which purport to describe intra-Trinitarian relations, it refers to the Trinity in toto-thus in holding that the Son and Holy Spirit proceed from the Father we affirm that the Trinity is the source and unifying principle of Trinitarian Persons. While this account is solves a nagging problem for Social Trinitarians it is theologically minimalist to the extent that it is compatible with both Social Trinitarianism and Latin Trinitarianism, and with heterodox Modalist and Tri-theist doctrines as well. Its only theological cost is incompatibility with the Filioque Clause, the doctrine that the Holy Spirit proceeds from both the Father and the Son—and arguably that may be a benefit. (shrink)

Prima facie, relative identity looks like a perfect fit for the doctrine of the Trinity since it allows us to say that the Father, Son and Holy Spirit, each of which is a Trinitarian Person, are the same God but not the same Person. Nevertheless, relative identity solutions to logic puzzles concerning the doctrine of the Trinity have not, in recent years, been much pursued. Critics worry that relative identity accounts are unintuitive, uninformative or unintelligible. I suggest that the relative (...) identity account is worth a second look and argue that it provides a coherent account of the doctrine of the Trinity. (shrink)

In its original expression as a medical value confidentiality may have been absolute; this concept has become eroded by patient consent, legal actions and change in the climate of public opinion. In particular requirements arising out of legal statutes and common law judgements have greatly modified the confidentiality of the doctor-patient relationship in societies deriving their law from English origins. Despite this, confidentiality remains a value which the physician must strive to preserve. He cannot however do this without considering its (...) effect upon possible innocent third parties.
